Context:
The Ministry of Corporate Affairs (MCA) has established the C-PACE (or the Centre for Processing Accelerated Corporate Exit), thereby centralising the strike-off process of companies.
-
The Registrar of Companies in MCA maintains the list/register of all companies registered in India.
-
Why is C-PACE necessary? After the exit of a company from Business, the company is delisted from this Register. But this process is very slow. C-PACE will handle this process swiftly.
ABOUT C-PACE
-
C-PACE was established through an MCA Notification in March 2023.
-
It is situated at the Indian Institute of Corporate Affairs (IICA), IMT Manesar, Gurgaon (Haryana).
-
Further, in April 2023, MCA amended the Companies (Removal of Names of Companies from the Register of Companies) Rules, 2023 easing the exiting process. It came into effect on 1st May 2023.
-
The C-PACE is operating through the Registrar of Companies (RoC) for the purposes of exercising functional jurisdiction of processing and disposal of applications.
Advantages of C-PACE
-
Keeping the Register of Companies clean: This will help to reduce the stress on the MCA Registry of Companies along with keeping the registry clean.
-
Meaningful data: The availability of more meaningful data to the stakeholders.
-
Ease of complete exit: The C-PACE will also benefit the stakeholders by providing a hassle-free filing, timely and process-bound striking off their company’s names from the Register.
-
And therefore, it will improve the ease of doing Business in India.
-
The setting up of the C-PACE is part of the several measures taken by MCA in the recent past towards Ease of Doing Business and ease of exit for the Companies.
