1. Ministry of Home Affairs declares ‘Jammu & Kashmir Democratic Freedom Party’ (JKDFP) as ‘Unlawful Association’
Topic: GS2 – Indian polity.
Context:
- The Government of India has declared the ‘Jammu and Kashmir Democratic Freedom Party’ (JKDFP) as an ‘Unlawful Association’ under Section 3(1) of the Unlawful Activities (Prevention) Act (UAPA) 1967.
What does it mean by ‘Unlawful Association’:
An “Unlawful Association” refers to an organization, group, or association that has been declared illegal or prohibited by the Indian government under the Unlawful Activities (Prevention) Act, 1967 (UAPA).
Under this law, the government has the authority to declare an association as unlawful if it believes that the association is involved in activities that pose a threat to national security, public order, or the sovereignty of the country.
When an association is declared unlawful in India:
- Its activities become illegal: The association is prohibited from carrying out its activities, and any actions taken by it can be considered unlawful.
- Membership restrictions: People can be prohibited from being members of such an association, and those already associated may face legal consequences.
- Asset freezing: The government may freeze the assets of the unlawful association, preventing it from using funds for its activities.
- Legal actions: Legal action can be taken against members and leaders of the association, including arrest and prosecution.
